It also gives details regarding his private life: his fortune, his domestic life, and even his most cherished memories. We will describe and analyze two dossiers, the first of which –related to the events that occurred immediately after his death– is kept in the Library of the Supreme Court of Justice in Santiago, and the second –written a couple decades later, due to the publication of La Filosofía del entendimiento y Poema del Cid–, in the National Historical Archive of Chile. The author of this paper explains the background that caused the publication of said booklet, with special emphasis on the conflict that erupted when an attempt was made to reestablish the old Instituto Nacional to the Seminario Conciliar in 1819. A detailed analysis is made of the argumentation and bibliography used by José Antonio Rodríguez, which shows the extent of his legal knowledge of the Spanish-colonial tradition. This tradition was, in turn, permeated by the illustrated catholic current of thought that flourished in Spain, in a regalist and historicist mindset, aiming towards conciliarism and a reduction of the faculties of the Roman Curia. The solid formation the author received in the Real Colegio Mayor de San Carlos and the Real y Pontificia Universidad de San Marcos is also mentioned, with special emphasis in the cultural development of the city of Lima, one of whose most conspicuous exponents was Toribio Rodríguez de Mendoza. All of this influenced the writing of the aforementioned booklet. It included the examination of the justice imparted by mayors, subdelegates and inspectors of Colchagua, one of the largest provinces in the country. Based on the reports that the visitor referred to the Ministry, the article identifies the characteristics of this unfinished business (the visitor resigned after visiting two of the nine provinces involved in the inspection) and analyzes the border areas between legal judicial practices and legal inspection. This article seeks, through a preliminary biographical reconstruction and, fundamentally, by compiling his performance during the constituent process of 1925, demonstrate Hidalgo’s commitment to ideas that would later become “Social Democrats”, showing in this sense his link with the basal and real political idea of Luis Emilio Recabarren, of which he was loyal squire during the time of the Socialist Workers’ Party (going forward, POS) and even later, having already transformed it into the Communist Party of Chile (going forward, PCCh). This coincidence is remarkable since two independent legislations, at least in theory, had the same influences for the purpose of building a property registration system that was appropriate to the new times that were running, and which, due to problems of a political nature and practices, did not they had a legal representation until well after they were published. We refer to the texts of Anthoine de Saint-Joseph of 1840, called Concordance entre les codes civils étrangers et le Code Napoleón, translated into Spanish by the lawyers of Madrid, Fermín Verlanga and Juan Muñiz in 1843; and, the book of Florencio Garcia Goyena of date 1852, titled Concordances, motives and commentaries of the Spanish Civil Code, in which the jurist Claudio Anton de Luzuriaga also contributed remarkably. This work aims to show that the rules contained in articles 2392 and 2397, second paragraph, of the Chilean Civil Code, have a remote origin lost in history, which was adopted in our Civil Code by Andrés Bello. These restrictions refer to three specific areas: a) The prohibition of appropriating the assets of the debtor to pay the debt, contained today in the second paragraph of article 2397 of the Chilean Civil Code; b) The prohibition of taking into warranty the assets of the debtor in order to ensure the payment of the debt, contained on the first paragraph of article 2392; and c) The prohibition for the creditor o retain assets of the debtor in order to ensure the payment of the debt, contained on the second paragraph of article 2392. Their hispanoamerican origins allowed a blossoming with baroque and modern characteristics that the author analyzes pointing out that they have marked them with their respective imprints. Various periodizations are shown which contribute to drawing parallels and underlining differences. The reader receives guidance regarding the historiographic production that has been written about Ibero-American universities and their achievements. Se trata del texto del primer curso que ofreciera Andrés Bello, recién llegado a Chile en 1830, a los alumnos del Colegio de Santiago. The practice began upon the assumption of Pius X (1903-1914) and continued with Benedict XV (1914-1922), who received one relating to Chile from the internuncius Enrico Sibilia. He emphasized the good relations with the government of Chile, but not with the Chilean Curia, which he described as infested with Gallicanism, which the clergy acquired in their formation in the Seminaries. Those Gallicanist manifestations dealt with the recursos de fuerza (finished in 1874), the consideration of the Pope as just a bishop, the derecho de presentación which implied certain understanding between Chile and the Holy See towards the designation of the Chilean Church’s most important apointments and the ill treatment that, in general, the papal representatives had received, which he attributed to the action of the Chilean ecclesiastical leaders. As a solution, he suggested the signing of a Concordat in which these matters would be addressed and settled.
