Legal determination of punishability in negligent crimes

Abstract

This paper is consists of two parts. The first part seeks to introduce the problem of legal determination of punishability in general. The second part explains how criminal law serves as a general-abstract enabling basis to configure the declaration of culpability and the imposition of punishment in particular cases and for specific recipients.
